Two Voluntary Dismissals in Response to Motions for Summary Judgment – Broward County

On August 21, 2023, Butch Mathenia, Esq. of Scarborough Attorneys at Law obtained two voluntary dismissals in response to the Motions for Summary Judgment filed in two separate cases. Plaintiff’s Complaints, filed in Broward County, alleged breach of an insurance contract due to the Insurer’s failure to pay Plaintiff, glass shops invoices. Mr. Mathenia, on behalf of the defendant insurer moved for summary judgment based upon Plaintiff’s failure to provide pre-suit notice of the losses to the defendant insurer before filing suit. At the direction of the Defendant insurer, Mr. Mathenia also served proposals for settlement to the Plaintiff, which were not accepted. On the eve of the Motion for Summary Judgment hearings, Plaintiff, realizing the error of bringing the lawsuits, and facing sanctions for not accepting Defendant’s proposals for settlement, voluntarily dismissed the actions. Mr. Mathenia’s aggressive litigation strategy resulted in a timely and cost-effective defense for the client.
